End User License Agreement

This End User License Agreement (“Agreement” or “EULA”) is a legal agreement between you (“User”, “you”, or “your”) and BrandSentry (“we”, “us”, or “our”) governing your access to and use of the BrandSentry platform, including all features, tools, APIs, and related services (collectively, the “Service”). By creating an account, accessing the Service, or clicking “I agree”, you confirm that you have read, understood, and agree to be bound by this Agreement. If you do not agree, you must not use the Service.


1. Acceptance of Terms

By registering for or using the Service, you represent that:

  • You are at least 18 years of age or the age of legal majority in your jurisdiction.
  • You have the legal authority to enter into this Agreement on behalf of yourself or the organisation you represent.
  • Your use of the Service will comply with all applicable laws, regulations, and this Agreement.

2. License Grant

Subject to your compliance with this Agreement and timely payment of any applicable subscription fees, BrandSentry grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service solely for your own internal business purposes during the subscription term.

This licence does not include any right to: (a) sublicense, resell, or distribute the Service; (b) create derivative works based on the Service; or (c) access the Service in order to build a competing product or service.


3. Permitted Use

You may use the Service to:

  • Monitor the uptime and performance of websites and domains that you own or are explicitly authorised to monitor.
  • Run port scans, subdomain discovery, SSL checks, DNS lookups, and broken-link scans on domains you own or control.
  • Monitor server resources (CPU, RAM, disk) on servers you own or administer.
  • Receive and manage alerts, incidents, and reports generated by the platform.
  • Invite team members within your organisation to collaborate on your account.
  • Export data and reports for your own internal business use.

4. Restrictions

You must not, directly or indirectly:

  • Use the Service to scan, probe, or test domains, IP addresses, or servers that you do not own or do not have explicit written permission to test. Unauthorised scanning may constitute a criminal offence.
  • Use the Service to conduct denial-of-service attacks, brute-force attacks, or any form of malicious network activity.
  • Attempt to gain unauthorised access to any part of the Service, its servers, or any related systems.
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service.
  • Scrape, crawl, or systematically extract data from the Service using automated means other than our official API.
  • Use the Service to transmit spam, malware, or any content that is unlawful, harmful, or offensive.
  • Remove, obscure, or alter any proprietary notices, branding, or labels in the Service.
  • Share your account credentials with unauthorised third parties or allow multiple individuals to use a single-user account.
  • Circumvent any rate limiting, access controls, or security measures implemented in the Service.
  • Resell, white-label, or commercialise access to the Service without a separate written agreement with BrandSentry.

5. User Accounts & Security

You are responsible for:

  • Keeping your login credentials and API keys confidential and secure.
  • All activity that occurs under your account, whether or not you authorised it.
  • Notifying us immediately at our contact page if you suspect unauthorised access to your account.

We recommend enabling two-factor authentication (2FA). BrandSentry will never ask for your password via email or support channels. We reserve the right to suspend or terminate accounts that show signs of compromise or are used in violation of this Agreement.


6. Authorised Scanning & Testing

BrandSentry performs automated monitoring and security scans as part of the Service. By adding a domain or server to the platform, you:

  • Confirm that you own or have explicit written authorisation from the owner to perform network scans, port scans, SSL checks, subdomain enumeration, DNS lookups, uptime checks, and broken-link crawls on that domain or server.
  • Grant BrandSentry permission to perform all current and future scanning and monitoring tools included in the Service against that domain or server.
  • Agree to indemnify BrandSentry against any claim arising from scans performed on domains or servers you added without proper authorisation.

BrandSentry reserves the right to suspend scanning for any domain or server if we receive a credible complaint that you do not have authorisation to monitor it.


7. Subscription, Billing & Payments
7.1 Subscription Plans

The Service is offered on a subscription basis. Plan details, features, and pricing are described on our pricing page. We reserve the right to modify plans and pricing with reasonable advance notice.

7.2 Billing & Renewal

Subscriptions are billed in advance on a recurring basis (monthly or annually, depending on the plan you select). Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.

7.3 Payment Processing

Payments are processed by third-party payment processors (such as Stripe, PayPal, or Paddle). You agree to provide accurate billing information. We do not store full credit card details on our servers.

7.4 Refunds

Subscription fees are generally non-refundable. However, if you believe you have been charged in error, please contact us within 14 days of the charge and we will investigate in good faith.

7.5 Taxes

All fees are exclusive of applicable taxes. You are responsible for any value-added tax (VAT), sales tax, or other taxes imposed on the Service in your jurisdiction.


8. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into this Agreement by reference. By using the Service, you consent to the collection and use of data as described in the Privacy Policy.

You retain ownership of your data. BrandSentry processes your data solely to provide the Service and as otherwise described in the Privacy Policy. We do not sell your data to third parties.


9. Intellectual Property

All right, title, and interest in and to the Service — including all software, algorithms, designs, trademarks, logos, and documentation — are and remain the exclusive property of BrandSentry and its licensors. Nothing in this Agreement transfers any intellectual property rights to you.

You grant BrandSentry a limited, worldwide, royalty-free licence to process and display the data you submit to the Service solely for the purpose of providing the Service to you.


10. Third-Party Services

The Service integrates with or relies on third-party tools and services (e.g., Stripe, Google, Sentry, email delivery providers, cloud infrastructure). These third-party services are governed by their own terms and privacy policies. BrandSentry is not responsible for the availability, accuracy, or conduct of any third-party service.

If you choose to connect third-party integrations (such as Google Sheets export or Gmail import), you are solely responsible for ensuring your use of those integrations complies with the relevant third-party terms.


11. Availability & Service Level

We aim to keep the Service available 24/7 but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to scheduled maintenance, emergency maintenance, third-party infrastructure issues, or circumstances beyond our control.

We will endeavour to notify you in advance of planned maintenance windows where possible. Temporary unavailability does not entitle you to a refund or credit unless expressly stated in a separate service-level agreement signed with BrandSentry.


12. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BRANDSENTRY EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION:

  • Any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • Any warranty that the Service will be uninterrupted, error-free, or free of viruses or harmful components.
  • Any warranty that scan results, uptime data, or security reports will be accurate, complete, or timely.

Security scanning tools are provided for informational purposes. BrandSentry does not guarantee that scans will detect all vulnerabilities, and scan results should not be the sole basis for security decisions.


13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • BRANDSENTRY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.
  • BRANDSENTRY’S TOTAL CUMULATIVE LIABILITY TO YOU ARISING OUT OF OR RELATED TO THIS AGREEMENT WILL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES YOU PAID TO BRANDSENTRY IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $100.

These limitations apply regardless of the theory of liability (contract, tort, statute, or otherwise) and even if BrandSentry has been advised of the possibility of such damages. Some jurisdictions do not allow limitations on liability, so the above may not apply to you in full.


14. Indemnification

You agree to indemnify, defend, and hold harmless BrandSentry and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service in violation of this Agreement or applicable law; (b) your unauthorised scanning of third-party domains or servers; (c) any data you submit to the Service; or (d) your infringement of any third-party rights.


15. Termination
15.1 Termination by You

You may cancel your subscription and close your account at any time from your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to the Service until then.

15.2 Termination by Us

We may suspend or terminate your access to the Service immediately and without prior notice if: (a) you materially breach this Agreement; (b) we are required to do so by law; (c) you engage in fraudulent or illegal activity; or (d) your account poses a security risk to the Service or other users.

15.3 Effect of Termination

Upon termination, your licence to use the Service ends immediately. You may export your data before your account closes. We will retain and delete your data in accordance with our Privacy Policy. Sections 9 (Intellectual Property), 12 (Disclaimer of Warranties), 13 (Limitation of Liability), 14 (Indemnification), and 17 (Governing Law) survive termination.


16. Changes to This Agreement

We may update this Agreement from time to time. When we make material changes, we will update the “Last updated” date on this page and notify you by email or via an in-app notice at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Agreement. If you do not agree to the changes, you must stop using the Service and cancel your account before the effective date.


17. Governing Law & Dispute Resolution

This Agreement is governed by and construed in accordance with the laws of the jurisdiction in which BrandSentry is established, without regard to its conflict-of-law provisions.

Any dispute arising out of or in connection with this Agreement that cannot be resolved amicably within 30 days of written notice will be submitted to binding arbitration or, where arbitration is not permitted by law, to the exclusive jurisdiction of the courts of BrandSentry’s jurisdiction of establishment.

Class action waiver: You agree that any dispute will be resolved on an individual basis and not as part of a class, collective, or representative action.
